Gambling regulation in Brazil

Brazil banned fixed-odds betting on 25 September 2026. Provisional Measure No. 1,394 prohibits operating, offering, intermediating and advertising fixed-odds betting lotteries anywhere in the country, online or in physical outlets, including by operators based abroad that offer them to people in Brazil.

Who regulates gambling in Brazil?

The Secretaria de Prêmios e Apostas (SPA), a body of the Ministry of Finance, regulates gambling in Brazil. It is responsible for fixed-odds betting, commercial promotions, charity draws and lotteries, and its job is to authorise, regulate, monitor, supervise and sanction companies in the sector.

Is online casino legal in Brazil?

No. The ban covers bets on "virtual events of online games", which the measure defines as games whose result is decided by a random generator of numbers, symbols, figures or objects.

Is sports betting legal in Brazil?

No. The ban covers fixed-odds bets on real sports events, online and in physical outlets. Open bets not settled within ten days of the measure's publication are void and the stakes go back to the bettor in full.

What gambling licences are there in Brazil?

Federal betting authorisations (being withdrawn)

No new betting authorisations are issued, and applications still pending on 25 September 2026 lapse. Authorisations granted under Law No. 14,790 of 2023 end 30 days after the measure's publication, with no refund of the authorisation fee and no compensation from the state.

Concessions, permissions and authorisations for fixed-odds betting granted by the states and the Federal District end on the same 30-day term.

What are the key rules for operators in Brazil?

Closing down

Operators must take their betting sites and apps offline, app stores included, ten days after the measure's publication, or face blocking. No new money may enter player accounts from the publication date.

Player funds

Operators have two days after going offline to secure the money owed to bettors and send the list of refunds to their banks and to the SPA; the banks then have seven days to pay. Missing these duties costs an operator R$200,000 a day.

Advertising

Advertising, marketing and sponsorship for fixed-odds betting are banned in every medium. Advertising material and sponsorship signs must be removed within ten days of the measure's publication.

Payments

Banks, payment institutions and payment schemes, instant payments included, may not process transactions for fixed-odds betting, except those needed to wind operations down and refund bettors.

Records and AML

The end of an authorisation does not end an operator's duties for the period it was licensed: tax and regulatory payments, anti-money-laundering, responsible gambling and sports integrity obligations remain, and records must be kept for at least five years.

Provisional Measure No. 1,394 took effect on publication in an extra edition of the official gazette on 25 September 2026 and repealed the core of the 2023 betting law.

Under the regime the ban replaced, only companies authorised by the SPA could operate nationally from 1 January 2025; each authorisation allowed up to three brands, on sites using the ".bet.br" domain.
